Please read these before you use our app, available for Android devices.
These terms and conditions apply to your use of Dam Safety Intelligence Limited's app and form a legal contract between you, the registered user, and us, Dam Safety Intelligence Limited (DSI). It's important that you read and understand these terms and conditions before using DSI's app, as installing and using DSI's app constitutes acceptance of these terms and conditions.
These terms and conditions should be read together with our Privacy Policy.
DSI does not guarantee that the operation of DSI's app will be continuous, complete or error-free. To the extent permitted by law, we do not accept any liability or responsibility whatsoever if DSI's app is not available, complete or error-free over any period or at any particular time.
Unless stated otherwise in these terms and conditions, nothing in these terms and conditions gives you any right, title or interest in any intellectual property rights relating to DSI's app, including DSI and/or other brands, trademarks (whether registered or otherwise), music or soundbites and/ or images and designs. You may use the material or intellectual property on DSI's app for the purpose of accessing DSI's services through DSI's app (the "Purposes"). However, that material or intellectual property may not be reproduced or used by you in any other manner whatsoever.
You must not duplicate, copy, reproduce, reverse-engineer, distribute, transmit, adapt, republish, display, or use DSI's app or any of its contents, in any form or manner, except to use it for the Purposes.
DSI's app requires you to create a username and password which must be provided to DSI before you can use the app. You are responsible for keeping your username and password safe and secure so as to prevent any unauthorised use of, and access to, your account and DSI's app. You will be responsible for all use of your account through DSI's app, even unauthorised use of and access to your account.
DSI won't charge you for downloading DSI's app, but your internet provider or mobile network provider may charge you for connection services when you download and/or use DSI's app. You agree that DSI is not responsible for any of those charges. You must comply with any applicable third-party service providers' terms of use (for example, software providers and network service providers) when using DSI's app.
To the maximum extent permitted by law, DSI:
excludes all warranties and liabilities that may apply to your use of DSI's app; and
is not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, a handheld device or mobile device as a result of the installation or use of DSI's app.
By clicking "Install" you agree that DSI can change the terms and conditions that apply to DSI's app by DSI giving 5 days written notice by email. If you do not want to be bound by those changes to the terms and conditions, you can uninstall the app before the changes take effect, as outlined in the clause below "Stopping your use of DSI's app." From time to time, we may upgrade DSI's app. If you do not install the upgrade, some or all of the functionality on DSI's app may not be available to you.
You may stop using DSI's app at any time by uninstalling DSI's app. Once
you have uninstalled DSI's app, the rights and licenses granted to you
under these terms and conditions will end.
When you use our app and the functionality (services) it provides then we will collect information about you and your use of the app. This description relates to our use of information collected via the app where it is specific to the app. In this section, 'we', also includes our technology platform provider, Catalyst.Net Limited, who may use this information where it is required in order to perform app related services for DSI.
When you download and use our app we may collect information to help us understand how you are using it, track and administer it, and diagnose problems. We may also collect information to provide services to you, including any services we agree to provide under a separate agreement with you.
The information that may be collected about your device includes the model and brand (e.g. LG Nexus 5, Samsung Galaxy 7, etc), the operating system version, the screen resolution, the date and time on it, video graphics card and memory available, the internet protocol address, etc.
If you are a DSI client and you log in, the app may also collect from our IT systems and display on your device the personal information necessary to operate your account. In addition to routine device permissions e.g. access to the internet in order to be able to work, our app:
accesses your device's memory to cache certain images to load them faster for you;
accesses your device's camera including to use the flashlight and your gallery;
accesses your devices GPS location;
sends us a crash report, if the app crashes. As part of the crash report, we (and our sub-processors as well as Google Play) receive basic device information (such as device model and operating system version) and the version of the app you are using .
If the app crashes, we receive a crash report, and so does Google Play (depending on your phone operating system). You can control whether Google receives information about errors and crashes, by checking your device settings
These terms and conditions are governed by and construed in accordance with New Zealand law. You agree to the non-exclusive jurisdiction of the courts of New Zealand in relation to all disputes arising out of or in connection with these terms and conditions.
You acknowledge that these terms and conditions are between us and you, and not Google Inc. You are given a non-transferable license to use DSI's app on your device in accordance with these conditions of use and the terms of service and policies applicable to your use of Google Play.
You warrant that you are not located in a country that is subject to a US Government embargo or is designated by the US Government as a 'terrorist supporting' country, and you are not listed on any US Government list of prohibited or restricted parties.
In these terms, "DSI" and "we" also includes any Related Company (as that term is defined in the Companies Act 1993) of DSI.
